Distance Sales Agreement

1. Parties
1.1. Seller

1.2. Buyer
The natural or legal person possessing the name, surname, address, phone, and email information declared by the buyer during the order. The buyer agrees to become one of the parties to this agreement upon order confirmation.
2. Subject of the Agreement
This agreement is prepared in accordance with the provisions of Law No. 6502 on the Protection of Consumers and the Regulation on Distance Contracts, for the purpose of regulating the rights and obligations of the parties regarding the sale and delivery of the product or products, whose characteristics and sales price are specified below, ordered electronically by the buyer on the seller’s website kavela.furniture.
3. Product Subject to the Agreement
The type, kind, quantity, color/size (variant if any), brand/model, sales price, payment method, and delivery information of the product are the information confirmed by the buyer in the cart and included in the order summary. This information is an integral part of this agreement.
4. Price and Payment
- Product prices are the prices announced on the site and valid at the time of order confirmation. Prices include VAT.
- Payments are collected via credit card, debit card, or wire transfer/EFT through the iyzico infrastructure. Card information is not stored on Kavela servers; payment transactions are carried out by a PCI-DSS compliant payment institution.
- If there is a delivery fee specified in the order summary, it is included in the order total.
5. Delivery
The product is delivered to the address specified by the buyer during the order, within 4–8 weeks from the confirmation of the order, depending on stock and production status. For custom-made and project-based orders, the period is additionally notified in writing in the order confirmation.
In cases where delivery is delayed due to force majeure (natural disaster, strike, war, pandemic, public restriction, etc.), the seller immediately informs the buyer. The delivery period restarts upon the elimination of the force majeure.
Additional costs arising from deliveries that cannot be made because the delivery address was incorrectly/incompletely reported by the buyer belong to the buyer.
6. Buyer’s Declarations and Obligations
- The buyer accepts that they have read, understood, and confirmed electronically the preliminary information form, including the basic characteristics of the ordered product, sales price, payment method, delivery time, and the seller’s contact information.
- By accepting this agreement, the buyer accepts that the obligation to pay for the ordered product arises.
- It is the buyer’s responsibility to check for visible damage, missing or incorrect products upon receipt of the product, and to have a delivery report prepared if any are detected.
7. Seller’s Declarations and Obligations
- The seller undertakes to deliver the product subject to the agreement defect-free, with the promised characteristics, intact, and in compliance with standards.
- If the delivery of the ordered product becomes impossible, the seller notifies the buyer in writing within 3 days from the date of learning of the situation and refunds the total collected amount and any documents creating a debt obligation within 14 days at the latest.
- The seller processes personal data only for the purposes disclosed in the Privacy Policy and in compliance with the provisions of the KVKK.
8. Right of Withdrawal
The buyer has the right to withdraw from the agreement within 14 days from the date of delivery of the product to themselves or the person/organization at the specified address, without giving any reason and without paying a penalty. 9. Exceptions to the Right of Withdrawal
Pursuant to Article 15 of the Regulation on Distance Contracts, the right of withdrawal cannot be exercised for custom-made and bespoke products prepared according to the buyer’s requests or clearly personal needs, and for products that cannot be returned due to their nature.
10. Default Cases and Legal Consequences
In the event that the buyer fails to fulfill their obligations arising from the agreement with the card organization for payments made by credit card, the seller reserves the right to claim the damages incurred according to general provisions.
11. Authorized Court
In disputes arising from the implementation of this agreement, District/Provincial Consumer Arbitration Committees are authorized within the value limits announced annually by the Ministry of Trade, and Consumer Courts are authorized for disputes above these limits. The buyer may apply to the arbitration committee/court in the place of their residence or where the consumer transaction was made.
12. Entry into Force
With the order confirmation, the buyer declares that they have read, understood, and accepted all provisions of this agreement electronically. The agreement enters into force with the order confirmation and terminates upon the completion of the parties’ obligations.
